Many people do not realize that in Florida, the general rule is that each side in a civil case pays their own legal fees, regardless of who wins and who loses. There are three things that can change the general rule and allow you, as the winner, to recover your legal fees from the losing party:
- If the lawsuit involves a contract that says the loser pays the winner’s legal fees;
- If the lawsuit involves a statute that requires the loser to pay the winner’s legal fees; or
- If a formal Proposal for Settlement is made according to the strict requirements of law.
